Madonna Cleared for Second Adoption; Father Says ‘I Need my Baby’

The highest Malawian court made a decision to overturn the previous decision of a lower court, and gave pop star Madonna the clearance to adopt a second child from the country.

Chief Justice Lovemore Munlo said the Madonna’s crusade to support the country’s disadvantaged children should have been taken into consideration before she was denied a second adoption of 3-year-old Chifundo “Mercy” James last March, reports CBS News.

The pop star established a charity that assists in education, food and medical provisions for Malawian orphans called Raising Malawi. The Southern Africa country is home to more than 1 million orphans, half have lost their parents to AIDS.

A Malawian man by the name of James Kambewa claims he is Mercy’s biological father and opposes the adoption. Kambewa said he was told his daughter died in childbirth. In Friday’s ruling, the high court made no mention of the man’s objections, stripping him of all his parental rights.

According to a CBS correspondent, he said after the ruling,”I’m crying. I need my baby. I don’t know where I can find any help.”

In a statement Madonna issued Friday, she said, “I am extremely grateful for the Supreme Court’s ruling on my application to adopt Mercy James. I am ecstatic. My family and I look forward to sharing our lives with her.”

In the Friday court hearing, the judge said she only saw two options for the little girl, “either to stay at the orphanage without the love of family and live with the possibility of destitution, or be with Madonna where she is assured of love. Every child has the right to love.”

Mercy’s mother was 18-years old when she died shortly after she gave birth. Since the buzz of the celebrity adoption, the girl’s maternal relatives have agreed to Madonna adopting the child, except for the man believed to be her father who want to care for her himself.

One of Mercy’s uncles said the family is overjoyed with the court’s decision.

“We hope Mercy will be joining Madonna soon.”
